# Acceptable Use Policy

## 1. About this policy

**1.1** This Acceptable Use Policy ("**Policy**") sets out the rules that apply to the use of the Seen Platform, including Studio and any AI features made available within it. It forms part of the Agreement between Seen and the Client, and supplements the obligations set out in the Terms and Conditions and the Data Processing Agreement, which it does not repeat.

**1.2** This Policy applies to the Client, its Affiliated Companies, and every individual the Client permits to access the Platform (together, "**Users**"). The Client is responsible for ensuring that all Users comply with this Policy. Users must not authorise, enable or encourage any third party to carry out any activity prohibited by this Policy.

**1.3** Capitalised terms not defined in this Policy have the meaning given in the Terms and Conditions. Where this Policy conflicts with the Terms and Conditions or the Data Processing Agreement, those documents prevail.

**1.4** Certain AI features are provided using models operated by third parties. Additional terms may be presented when such a feature is enabled for a workspace. Those terms form part of this Policy for that feature, and a workspace administrator who accepts them does so on behalf of the Client.

**1.5** This Policy is not intended to restrict clearly labelled internal training, testing or demonstration uses of the Platform where a reasonable viewer would understand that the content does not describe any real person's actual identity, statements or endorsement.

## 2. Prohibited content

Users must not use the Platform to create, upload, store or distribute content that:

**a)** promotes or facilitates unlawful activity;

**b)** is defamatory, harassing, threatening, hateful or discriminatory, or incites violence against any individual or group;

**c)** is sexually explicit, or exploits, harms or sexualises minors in any way;

**d)** promotes or glorifies suicide, self-harm or eating disorders;

**e)** is fraudulent, deceptive or misleading, including phishing, spoofing, scams and disinformation;

**f)** impersonates any person or organisation, or misrepresents an affiliation, endorsement or statement, in a manner intended or likely to mislead;

**g)** constitutes unsolicited bulk communications or spam;

**h)** provides material support to any person or organisation designated under applicable sanctions or counter-terrorism laws; or

**i)** contains malware or any other harmful code.

## 3. AI features

When using AI features, Users must not:

**a)** remove, disable or interfere with any watermark, content credential or other marking that identifies content as AI-generated;

**b)** attempt to bypass or circumvent any content filter or safety control;

**c)** use output as a sole or contributing basis for decisions producing legal or similarly significant effects for individuals, including decisions relating to employment, education, credit, insurance or access to essential services, or to monitor or evaluate the performance or behaviour of workers; or

**d)** use output to train, develop or improve any AI model.

## 4. Platform integrity

Users must use the Platform for the Client's business purposes only, and must not:

**a)** attempt to gain unauthorised access to the Platform or any related system or network;

**b)** use the Platform to build a competing product or service;

**c)** scrape or extract data from the Platform by automated means;

**d)** consume computing or AI-generation resources excessively or disproportionately, or place an unreasonable load on the Platform; or

**e)** abuse credits, quotas, trials or promotional offers.

## 5. Availability

Some features, including certain AI models, may not be available in all territories. Users must not access or attempt to access a feature from a territory in which it is not made available.

## 6. Reporting

Suspected breaches of this Policy should be reported to [abuse@seen.io](mailto:abuse@seen.io), with a link to or description of the content and the reason for the report. Requests from individuals concerning their personal data are handled in accordance with the [Data Processing Agreement](https://seen.io/legal/data-processing-agreement).

## 7. Enforcement

**7.1** Where Seen reasonably believes that a breach of this Policy is deliberate or repeated, or presents a credible risk of harm to any person, to Seen or to the Platform, Seen may remove or disable access to content, or suspend access to a feature or to the Platform.

**7.2** Where practicable, Seen will notify the Client and give it a reasonable opportunity to remedy the breach before taking action, unless immediate action is necessary to prevent harm or to comply with law.

**7.3** The Client may contest an enforcement decision by contacting Seen at the address in section 6. Where possible, the review will be conducted by a person not involved in the original decision.

**7.4** Subject to the Data Processing Agreement, Seen may share information with the operator of an AI feature, or with a competent authority, where reasonably necessary to address a breach of this Policy or to comply with law.

## 8. Changes

Clause 19.1 of the [Terms and Conditions](https://seen.io/legal/terms-and-conditions) applies to changes to this Policy as it applies to changes to the Terms and Conditions.
